Parties to the trust agreement

The settlor, the trustee and the beneficiary.

  • The settlor: every individual or corporate entity;
  • The trustee: receives the assets and secures them in a trust estate, detached from its own estate;
  • The beneficiary: can be an individual or a corporate entity. It can also be the settlor. Its identity can be fixed at the signing date or the contract can only set the rules allowing its adhesion to the agreement after the signing date.
  • The third protective party: when decided by the settlor, it is the person in charge of ensuring the good execution of the agreement (Article 2017 of the civil code).
